Derecho comparado de la justicia transicional entre México y Colombia.
Abstract
The research was a study on the legal advances in Transitional Justice between Mexico and Colombia as a contribution to Peace Building and to contribute to the resolution of the violent social conflict in Mexico. The objective of the research was to analyse the legal framework of each country and visualise its legal evolution, using a methodology of a propositional level and a mixed approach, where the quantitative part corresponds to the databases on violence in Mexico and the qualitative approach is based on semi-open in-depth interviews with actors in the Special Justice for Peace in Colombia. The results show the importance of establishing Transitional Justice processes in Mexico and the limited applicable legislation currently in place. It was established that the origin of transitional justice in Colombia was due to an internal armed conflict caused by paramilitaries, and in the Mexican case it was observed that there is a perspective of justifying organised crime and drug trafficking as crimes.
